francisco still blocking a popular off-ramp. we'll have details on all that coming up. back to you. >> thank you. 5:01. we begin with a body found in a backyard in novato. it will be removed today. police started digging behind the house on rebecca way after a man was reported missing there. the body is still in the yard this morning. a coroner will do an autopsy to identify the person and find the cause of death. 74-year-old dale smith was reported missing two weeks ago but smith's wife, evelyn, didn't make the report. a neighbor did. >> i met with the neighbor walking my dog and she said something odd was happening, i was talking to evelyn and she was talking about dale in the past tense and that piqued her interest. she may have contacted the authorities. >> the boyfriend of the missing man's daughter tells cbs 5 that the family was told dale smith had died in tennessee in november. mr. smith was reported to have been suffering from two forms of cancer and also from heart

disease. we are getting word from cbs news that libyan leader moammar qaddafi could give another speech in the next couple of hours. meanwhile, thousands of foreigners continue to flee the violent uprising in libya but it's going to be another day before americans will be able to leave aboard a ferry to the island of malta due to weather conditions. world leaders are considering sanctions now against libya to stop the violence against anti- government protestors. >> these people just want their freedom. these people just want to live normal lives. >> suffering and bloodshed is outrageous and it is unacceptable. >> there have been estimates that as many as 1,000 protestors have been killed. but moammar qaddafi's son says those reports are exaggerated. and he denies the government has launched air strikes against libyan cities. $4 gas? you heard me right. if you filled up lately, you have noticed that prices at the pump have spiked. as anne makovec explains, it has to do with something they

call a fear premium. anne, good morning. explain that for us. >> reporter: good morning. first check out this very sorry sight behind me. we are 1/10 of a penny away from $4 a gallon gas here in south san francisco at this chevron station off airport boulevard. it's all because of what's being called the fear premium. gas prices keep going up here in the bay area. it is a ripple effect from the crisis in libya. in some spots, the price of a gallon of regular unleaded right now can be as high as $4 a gallon. some drivers now leaving their suvs and using smaller more fuel-efficient vehicles even motorcycles. experts say, though, the price hikes are not because people are using more gas. that's what normally we see as the reason. >> the price increase has very little to do with our demand in the united states. the world demand for oil is quite strong. >> reporter: all right. so what is it? what's happening is that oil traders are worried that oil

supplies will dry up. they have even coined that phrase fear premium. and it's being thrown around in the biz quite a bit, specifically oil companies and traders trying to pad their pockets. they are afraid that the revolution in libya will spread to other opec countries that the u.s. actually relies on, because california refineries do not use oil from libya. now, the last lundberg survey came out a couple of days ago and that had us with prices jumping a dime in the past week. the next one is coming out on sunday. we'll see where the numbers are. but again, the real evidence is when you drive down the street and see very depressing signs like the one here behind me. >> i tell you, anne, i hope our cbs 5 news van doesn't need gas. that could be triple-digit bill right there. >> reporter: we use a lot of gas, i'm sorry to say. so yeah, that's going to come out of our raises probably. >> anne, you're right. anne makovec in south san francisco. thanks for joining us.

stretching over towards union city and also into hayward. but really this just the setup. no snow just yet. but throughout the day, we are going to see some very cold air pouring into the bay area. seeing some of that right now and you can also see some white here, some white and pink. that's a wintry mix as that cold air is going to just drop down in our direction so by the afternoon, snow levels dropping to about 1,000 feet. that's right. many of the mountaintops especially in the north bay going to start to pick up snow and accumulating on the ground. highs today will be cool, 40s and 50s all around the bay area. and then it looks like it's going to get even colder toward tomorrow. i think that's when we have a better chance of wild snow levels around the bay area, possibly down to sea level as we head in toward friday evening and saturday morning. all right. let get a traffic check with elizabeth. affic check with >> ralphie isn't as bad as that kid who got his tongue stuck to the pole!

november. and if the blastoff goes ahead the discovery will travel to the international space station with a crew of six and a robot. it will be the 39th flight. blastoff set for 1 hour and 50 minutes. the san francisco police department will be allowed to consider the use of tasers by its officers. the police commission approving that idea last night by a 6-1 vote. the department plans to study the plan and report to the commission in 90 days. supporters of the plan say officer-involved shootings will be reduced if officers have the option of using tasers. critics though contend that stun guns are dangerous and are concerned that the officers could overuse them. a new era officially begins today in the san jose police department. chris moore will be sworn in this afternoon as police chief. the 25-year veteran had been serving as interim mayor since rob davis retired in october. mayor chuck reed will be delivering the opening remarks at the ceremony set to begin at 5:00 at city hall. this comes at a time when the police officers association is

not happy with the mayor. >> other similar sized cities have doubled sometimes even tripled the number of officers. >> that is a clip from the union's latest television ad criticizing mayor reed. the mayor wants officers to make pay and benefit concessions to help the city reduce the massive budget deficit and if they don't, the city is threatening to lay off as many as 350 officers. union leaders expressed their concerns at a news conference yesterday. >> today is about raising the alarm of a 350-officer cut. today is about raising the alarm of a 900-force police department protecting a city of over a million people. >> they say a scaled-down force would eliminate pro-active police work. the union says that could leave more crimes unsolved and raise the crime rate. mayor reed says the average total cost for a police officer has gone up 100% in the past

time it snowed at sea level in the bay area.. 35 years ago.. viewers have been sending in great pictures like this one of the last time it snowed at sea level in the bay area. this is like 30 years ago. it's going to happen again this weekend, lawrence. aka ralphie. [ laughter ] >> you're excited, i know. >> yeah. this is the best chance we have had in quite some time to see the snow make its way down to sea level but still, everything has to go perfect folks. but we are going to see snow around the bay area. there is no doubt about that. already seeing some scattered showers outside right now. some of that make its way in through redwood city and also into fremont. things going to stay unsettled and pretty showery throughout the day today.

colder air coming in and mostly cloudy, showers and chilly temperatures. 30s and 40s. by the afternoon the showers will continue as we head in toward the latter part of the day snow levels drops in the north bay first where we are going to see some of that cold air working its way in. and you get a sense of it right now. you're seeing a wintry mix. you see some white and pink showing up and cold air beginning to drop down in the bay area. all this energy coming down from the arctic pouring down to the skies bringing with it the chance of low snow levels. so showers and snow levels down to 1,000 feet around the bay area today. one two to inches of snow. up to 2 to 6" above 1,000 feet and over that 6" of snow. that's here in the bay area. that doesn't happen often. toward friday colder air that dives across the rest of the

bay area. i think that's when we are looking at the possibility of seeing some snow down to sea level especially into friday night. at some point real lose some of the moisture from the clouds and it will dry out and we won't see that precipitation. but if we do get that rainfall or that precipitation, friday overnight cold enough to see snow at low levels. get the cameras ready. don't see this happen very often. you could see snow right in your neighborhood. saturday afternoon, drying out, chance of more rain returning to the bay area as we look towards next tuesday. all right. let's check on that traffic now with elizabeth. >> back out to san francisco. they did completely clear that earlier accident that was for a time completely blocking the paul avenue off-ramp to southbound 101. the driver actually took off on food so san francisco police and chp were on scene for a while. now, that's gone. an earlier accident in san jose also cleared. so we are problem-free right now on bay area roads.

no big incidents in our chp reports. here's a live look at our sensors down the nimitz freeway. 880, 64, 69, 72 miles per hour. so as you can see, top speeds really throughout the east bay. same thing if you're coming through pleasanton approaching the dublin interchange. all your drive times for the east bay still in the clear, not much yellow on any sensor. down the eastshore freeway, 1 minutes from the carquinez bridge to the maze. westbound 580, 14 minutes out of the altamont pass. and as you just saw nimitz freeway 880 through oakland looks great. let's go out -- oh, and mass transit is all on time. here's live look at the sierra if you are planning a trip towards tahoe. right no, no chains required on any highway. mass transit is on time. i think of we have a shot of the south bay, as well. we have 280 traffic coming out of downtown san jose where everything looks good as you head up towards cupertino. remember our radio partners, kcbs 740-am and 106.9-fm. back to you.

us! your time is 5:31. topping our news: crews will be out digging in a north bay backyard this morning to remove a body found buried there. christin ayers reports. >> reporter: good morning. police making that gruesome discovery around 8:00 last night in the backyard of this novato home where a man-missing for months. police first sent out cadaver dogs but those dogs could not find conclusive evidence of a body. they later sent out excavators from the fbi and they discovered the body last night. the body is unidentified and police say there is a lot of work to do including continuing to remove the body this morning. neighbors say they knew something was wrong when the wife of the man who was missing

started acting strangely. >> i was walking my dog and a neighbor said evelyn was talking about dale in the past tense. that piqued her interest and i believe she may have contacted the authorities. >> reporter: 74-year-old dale smith is the man who was missing. we don't know whether or not that was his body. authorities are telling us that he had been suffering from bladder cancer and esophogeal cancer and also had some heart issues. mr. smith's wife has obtained a lawyer. they are not telling us much. they are only saying they believe he died of natural causes. >> thank you, christin ayers in novato. oakland police hope new surveillance video will help them solve a sexual assault case. officers say that the video shows the man who is suspected of attacking a woman near lake merritt. the victim says she was attacked in her apartment two weeks ago when she returned home. police say the man is not suspected in three previous

assaults in the area. libyan leader moammar qaddafi's son says reports that hundreds of protestors have been killed are exaggerated. qaddafi may be preparing to make another speech to his country shortly. meanwhile, foreign governments continue to get their citizens out of the country of libya but the ferry schedule to evacuate americans to the island of malta, it's still in tripoli because of the high seas in the mediterranean. other countries are considering sanctions to end the violence. how do you feel about $4 a gallon gas? you have noticed prices are on the way up. anne makovec explains that it has to do with something called fear premium linked to the crisis in libya. i don't like the sign behind you, kind of scary. >> reporter: it is very scary. we are 1/10 of a penny away from $4 a gallon here at the chevron station. i'm in south san francisco off

airport boulevard. not looking good here. things are rising very, very quickly. a ripple effect from the crisis in libya. and you may find that odd when you consider california refineries don't use any oil from the middle east. energy experts say it is the fear factor as frank mentioned because of the revolt in libya. world oil traders are afraid oil supplies may dry up. it might sound like an excuse when libya only producers 2% of the world oil supply but fear is a very strong pull. oil companies and traders are trying to pad their pockets in case the revolt in libya spreads to other opec countries that the u.s. does rely on. now, some people drive around trying to find the cheapest price. we caught one guy who accidentally came to this station. he just said he had no choice. >> i'm out of gas so i can't make it anywhere else so i have to stop here. usually i'll go to valero where

it's cheaper but i'm empty so i don't want to risk not making it. >> reporter: so this is one of the highest prices at 3.99 for regular gas. but we have seen a lot of 3.89s and again, all signs point to this all going up. frank? >> i know. and that is no fu whatsoever. thank you, anne makovec live in south san francisco. usually when people are heading up to tahoe, we tell them to carry chains if it's going it snow. lawrence, we don't need snow chains around here just yet, do we? >> yup, you may see -- >> no way! >> snow right here in the bay area!! down to some very low levels. already beginning to see cold showers developing around the bay area today. scattered showers in toward redwood city and fremont and, well, that will continue just light stuff right now just scattered showers out ahead of the cold front. but there's more of this that's sliding in our direction and the air is going to get colder as we head through the day today. i think as we head through the evening, we are looking at snow down to about 1,000 feet here

in the bay area. you have that cold snow, that wintry mix towards eureka, these areas. that moisture is heading our way. things are going to stay cool for highs today. expect highs only in the 40s and 50s. and we have a little snow coming our way. we'll talk more about that coming up. right now let's check traffic with elizabeth. >> coming around the corner, lawrence. all right. we are seeing brakes on 4. nothing unusual just a little slowing from a street to somersville road. elsewhere across the bay area, we are doing pretty well. no problems now coming in or out of san francisco on 101 or 280. we'll take this ride down along the peninsula, 101 looks great through san jose even all the way to morgan hill. traffic moving nice and quiet top speeds everywhere coming out of the altamont pass. 14 minutes to the altamont pass to the dublin interchange.

a snow plow, getting ready for what promises to be a cold, wet and snowy next few days.. we don't usually see snow plows in the bay area. getting ready for a cold wet and snowy next few days. caltrans has them on standby. viewers have been sending great photos of the last time it snowed at sea level in the bay area 35 years ago. look at that. lawrence! what do you think? could it happen this weekend? >> i remember being out -- >> look at the way everyone is dressed. >> that might be a bit older picture. [ laughter ] >> i remember being out in my playground in third grade when we did have that snow in the bay area in the '70s but you know what? there is the best chance that i can remember since doing this for over 20 years that we could see some snow down to sea level. now, it's getting interesting right now. we have that cold air and the

showers beginning to show up around the bay area. not the coldest air that we are going to see with the storm system but cold enough that we are beginning to see a wintry mix developing over some of the mountaintops so folks, yes, it has begun. we have some of that arctic air beginning to plow into the bay area. plow? yeah. they may need some snow plows the next couple of days right around the bay area mountains. mostly cloudy out the door. chance of showers throughout the bay area. seeing that right now. temperatures on the cool side, 30s and 40s by the afternoon. mostly cloudy skies, the showers will be picking up. temperatures for highs only in the 40s and 50s so far the mountaintops even colder and that's where we are expecting some of the snow to begin. you get an idea of the storm system seeing some of the clouds gathering here also seeing kind of a wintry mix beginning in parts of northern california. that cold air is going to plunge right into the bay area. showers, low snow levels especially toward the afternoon hours. it will be picking up in the north bay first. so with that in mind, checking

out our computer models and you will notice as we take you through the day here, we begin to see some of the white and pink, that's some snow beginning to creep down across parts of the north bay as we head in toward the latter part of the afternoon and then it looks like overnight, as we head in toward early friday morning, that air gets even colder and that's when we could actually see some of that snowmaking its way all the way down to sea level but you get the idea. that cold air making its way in our direction. and yes, folks, we got some interesting weather coming our way. winter weather advisories, snow levels running at about 1,000 feet around the bay area. even lower as we head in toward friday. temperatures for highs today only in the 50s and 40s. could be one wild friday around the bay area with a chance of some snowfall all the way down to sea level continuing into saturday morning before warming up and drying out on sunday. here's a look at traffic with elizabeth. >> you're even getting me excited about snow and wet weather. replacing its chief we are back. it is 5:53. and apple will not have to go public with its plan for replacing its chief executive. the issue came up at yesterday's shareholders meeting. last month steve jobs went on an indefinite medical leave with no details. some shareholders called for disclosure of a plan to ensure a smooth transition in case jobs decides to leave. but that proposal was voted down. it's payback time for home buyer who took advantage of that $7,500 tax credit back in 2008. the credit was not a freebie. it was actually an interest- free loan provided by the government to breathe a little life into the dying housing market. that loan must be paid back

over 15 years beginning with this year's tax return. congress has since changed the rule. the home buyer tax credit in 2009 and 2010 do not have to be repaid. the space shuttle discovery is on the launch pad at cape canaveral poised to lift off for the final time this afternoon. nasa says it's confident there will be no leaks of hydrogen gas or cracks in the fuel tank. both of those problems developed during an earlier countdown back in november. if the blastoff goes ahead, discovery will travel to the international space station. it will be discovery's 39th flight. you love this story because some of the brightest minds in science witnessed a little bit of history. >> the basketball team at cal tech ended, get this, a 310- game conference losin streak. they beat occidental college by one point tuesday night. the winning point from a computer science major, ryan em quist. >> he will never forget it. >> he is now off to play in the
